Martric Visuals is a photography brand based in Lisbon, Portugal, operated as an individual trader. We sell digital products (Lightroom preset packs) and physical products (fine art prints) through this website.

2. Our Products

Digital products (Preset packs)

Preset packs are digital files delivered electronically immediately after payment is confirmed. They are compatible with Adobe Lightroom as specified in each product listing. We make every effort to ensure product descriptions are accurate, but minor variations between previews and results may occur depending on your camera, shooting conditions, and Lightroom version.

Physical products (Fine art prints)

Fine art prints are produced to order by our fulfilment partner and shipped directly to your delivery address. Each print is made specifically for you; production typically begins within 1–3 business days of your order. Delivery times vary by destination and are estimated at checkout. Martric Visuals is not responsible for delays caused by carriers or customs authorities.

3. EU Consumer Rights & Right of Withdrawal

As a consumer in the European Union, you are protected by Directive 2011/83/EU on consumer rights, transposed into Portuguese law by Decreto-Lei n.º 24/2014. Under this legislation, you have the right to withdraw from a distance contract within 14 calendar days without giving any reason.

Exception for digital content (Preset packs):

In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to digital content delivered on a non-tangible medium (such as a download link) once performance has begun, provided you have given your prior express consent and acknowledged that you thereby lose your right of withdrawal. By completing your purchase of a preset pack and proceeding to download, you confirm this consent.

Prints (physical goods):

Because fine art prints are made to order to your specifications, they are exempt from the standard right of withdrawal under Article 16(c) of Directive 2011/83/EU. However, if your print arrives damaged, defective, or incorrect, please refer to our Refund Policy for how we will resolve the issue.

4. Pricing & Payment

All prices displayed on the website are in Euros (€) and include applicable taxes (VAT) where required by Portuguese and EU law. We reserve the right to change prices at any time; the price applicable to your order is the one shown at the time of checkout.

Payments are processed securely by our payment provider (e.g. Stripe). We do not store or have access to your full card number or banking credentials. By placing an order, you confirm that you are authorised to use the payment method provided.

In the event of a pricing error on our website, we reserve the right to cancel the order and issue a full refund. We will notify you promptly if this occurs.

5. Delivery of Digital Products

Preset packs are delivered electronically to the e-mail address provided at checkout, immediately after payment confirmation. If you do not receive your download link within 30 minutes, please check your spam folder and contact us at hello@martricvisuals.com.

Download links are valid for a reasonable period after purchase. If you experience technical difficulties accessing your files, contact us and we will assist you.

6. Licensing & Usage

When you purchase a digital product from Martric Visuals, you are granted a non-exclusive, non-transferable personal licence to use the presets in your own photography and creative projects, including for commercial work you personally produce.

You may not:

• Resell, redistribute, sublicense, or share the preset files with third parties.
• Include the presets in any product bundle, subscription service, or digital marketplace.
• Claim authorship or ownership of the presets.
• Use the presets to train artificial intelligence or machine learning models.

One licence covers use across your own devices. If you require a multi-seat or studio licence, please contact us.

7. Intellectual Property

All content on this website — including photographs, preset files, branding, text, and design — is the intellectual property of Martric Visuals and is protected under Portuguese copyright law (Código do Direito de Autor e dos Direitos Conexos) and applicable EU legislation.

Nothing on this website grants you any right to use our trademarks, trade names, logos, or domain names without our prior written consent. Unauthorised reproduction, distribution, or modification of any content is strictly prohibited.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Martric Visuals shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our products or website, including but not limited to loss of data, loss of profit, or business interruption.

Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the product in question.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under Portuguese or EU law. Your statutory rights as a consumer are not affected.

9. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of Portugal and applicable European Union regulations.

If a dispute arises, we encourage you to contact us first at hello@martricvisuals.com so we can attempt to resolve it amicably. If we are unable to reach a resolution, you may:

• Submit a complaint through the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
• Use an Alternative Dispute Resolution (ADR) entity recognised in Portugal, such as CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo) at www.cniacc.pt.
• Seek recourse through the Portuguese courts, which shall have exclusive jurisdiction for any disputes not resolved by the above means.

If you are a consumer in the EU, you also benefit from the mandatory consumer protection provisions of your country of residence, which cannot be derogated from by these Terms.

10. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our business practices or applicable law. The updated version will be posted on this page with a revised "Last updated" date. For significant changes, we will provide notice via our website or by e-mail.

Continued use of our website or purchase of our products after any changes are posted constitutes acceptance of the updated Terms.
